Most law firms have a partner or associate who does primarily real estate law. Some firms specialize in only real estate work. At some point, everyone who Buys or Sells real estate will need a lawyer's services. The deed or mortgage needs to be registered, the title on the property needs to be verified and changed, and of course there should be some research to find out if there are creditors claims against the property or even municipal matters outstanding or perhaps survey issues that will have to be addressed. Lawyers are also responsible for remitting the Land Transfer Taxes to the government. Title Insurance is also offered by lawyers. This form of insurance may be helpful in rural property deals where current survey documents are missing or there are additional restrictions or priviledges assigned to the title to the land. In subdivisions where there is regular turnover of properties, a lawyers' due diligence should suffice in conveying title to the purchaser. (Title Insurance is common in the USA where the transfer of title involves placing the ownership in "Escrow" while final checks and documentation is processed.) Realtors have received some training in many of the laws and government regulations that affect this industry. Realtors' associations try to stay abreast of the legal changes affecting the parties to real estate transactions. They even provide a broad range of legal forms and clauses to help expedite the hundreds of thousands of real estate transactions that occur every year. Realtors are not lawyers... and lawyers are not realtors. You should employ both professionals when you do a real estate transaction.
